These Terms & Conditions ("Terms") govern your access to and use of the website, water kiosks, mobile application, and related services (together, the "Services") provided by Swachh Jal Ghar ("Swachh Jal Ghar", "we", "us", or "our"). By accessing our website, purchasing water from a kiosk, or using our RFID/UPI payment systems, you agree to be bound by these Terms.

1. About Swachh Jal Ghar

Swachh Jal Ghar builds and operates smart, IoT-enabled water purification kiosks that provide clean drinking water at public locations such as railway stations, hospitals, transit hubs, and stadiums across India.

2. Use of Kiosks

• Kiosks dispense purified drinking water in exchange for payment via RFID card, UPI, or other supported digital payment methods, subject to the pricing displayed at the kiosk or in the mobile app.
• You agree to use kiosks only for their intended purpose and not to tamper with, damage, or attempt to bypass the payment or dispensing mechanisms.
• Kiosk availability, uptime, and water quality are monitored in real time; however, occasional downtime for maintenance, filter replacement, or technical issues may occur.

3. Payments and Refunds

• Payments made through RFID or UPI are processed securely through our payment partners. We do not store your full payment credentials.
• In the event a transaction is charged but water is not dispensed due to a kiosk malfunction, you may contact us using the details below to request a refund or credit, subject to verification.
• Mobile app "water wallet" balances, where available, are non-transferable and may be subject to expiry as disclosed in the app.

4. Website Use and Contact Form

When you submit an inquiry through our website contact form, you confirm that the information you provide (name, phone number, email address, and message) is accurate. We use this information solely to respond to your inquiry, as further described in our Privacy Policy.

5. Intellectual Property

All content on our website, including text, graphics, logos, product designs, and software, is the property of Swachh Jal Ghar or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

6. Partnerships and Institutional Hosting

Organizations hosting our kiosks (such as transit authorities, hospitals, or corporate partners) are subject to separate agreements governing installation, maintenance access, and revenue or service arrangements, which take precedence over these Terms for matters they specifically address.

7. Disclaimers

We strive to maintain 99.9% uptime and rigorous water quality standards through real-time telemetry and predictive maintenance. However, our Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the fullest extent permitted by law.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Swachh Jal Ghar shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of, or inability to use, our Services, including kiosk downtime or transaction issues, except where such liability cannot be excluded by law.

9. Indemnification

You agree to indemnify and hold harmless Swachh Jal Ghar, its officers, employees, and partners from any claims, damages, or expenses arising from your misuse of the Services or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of India, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Faridabad, Haryana.

11. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.
